We are committed to respecting your privacy and protecting your personal data. This privacy and cookie policy (the “Policy”) sets out how we use data relating to you, and applies to all use of your personal data by Landicia Ltd, a company registered in England and Wales with its registered office at 71–75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ (“we”, “us” or “our”).

This Policy applies to personal data we collect from you, or that you provide to us, through or in connection with our website at https://landicia.com and our application at https://app.landicia.com (together, the “Service”). Please read it carefully to understand our views and practices regarding your personal data.

We only collect and process information about you in accordance with this Policy and with applicable data protection law, including the UK General Data Protection Regulation (“UK GDPR”) and the Data Protection Act 2018. Where we decide the purpose or means of processing personal data that you provide when using the Service, we are the data controller.

The following explains what data we collect, how we use it, and who it may be shared with.

Account and subscription information

When you create an account or take out a subscription we collect your name, work email address, the organisation you work for, your role, and billing details. Card details are handled by our payment processor and are never stored on our systems.

We process this data to perform our contract with you: to give you access to the Service, to bill you, to provide support, and to send you service messages about your account, billing or changes to the Service.

Content you create in the Service

This includes the sites you save, the searches and filters you run, the letters and documents you generate, the owner contact details you record, and the outreach activity you log. We process this data to provide the Service to you, to keep your work available across sessions, and to provide support when you ask for it.

Property and planning data shown alongside your content is drawn from public registers and official services and is attributed to its source. Where that data includes information about identifiable individuals, see “Owner information” below.

Enquiry and support information

When you get in touch with us through the website, book a walkthrough, or contact support, we collect your name, contact details, the organisation you are contacting us on behalf of, how you heard about us, and any other personal data you send us.

In line with the legitimate interest we have in running and promoting our business, we process your enquiries to reply to you and to give you information about the services we offer. We may also process enquiries to take steps you ask of us with a view to entering into an agreement. You are under no obligation to provide us with any details, but if you do not provide the relevant information we may not be able to help.

Website analytics and usage information

When you visit the website or use the application we collect log and analytical information, such as your internet protocol (IP) address, browser type and version, time zone setting and approximate location, operating system and platform, the pages and features you use, and the times you use them.

We process this information to understand how the Service is used, to keep it secure and available, and to compile statistical reports about that activity. In many cases the data is aggregated or anonymised so that it does not identify you. Where this processing requires consent to the use of cookies or similar technologies, we rely on your consent; otherwise we rely on our legitimate interest in understanding and improving the Service.

Marketing

If you sign up to hear from us, or where you are an existing customer and we are permitted to do so, we may use your email address to send product updates, news, and information about content, services and events we think may interest you.

Where the law requires consent, we rely on your consent for this, and you can withdraw it at any time by using the unsubscribe link in any message or by emailing info@landicia.com. Otherwise we rely on our legitimate interest in marketing our business. We may share data about you with third party providers of analytics, marketing automation and email services, some of whom are based outside the UK.

Ownership details obtained through HM Land Registry are subject to that service’s own terms, and remain subject to Crown copyright. Landicia passes those terms on to you; it does not replace them.

Where you use the Service to identify, store or contact property owners, you act as the controller of that personal data. You are responsible for using owner contact details lawfully, including under the UK GDPR, the Privacy and Electronic Communications Regulations, and direct marketing rules. That includes having a lawful basis for contacting an owner, honouring objections and opt-outs, and telling people how you obtained their details where required.

We process owner data on your behalf as a processor when we store it, generate letters from it, and dispatch those letters at your instruction. Our terms of use set out the data processing terms that apply.

Title boundaries shown in Landicia are indicative and derived from the INSPIRE Index Polygons. Market and funding indications are illustrative and are not valuations, lending offers, or financial or professional advice. Official title plans and registers obtained from HM Land Registry remain the authority for any transaction.

The plan is billed monthly in advance and can be cancelled at any time, taking effect at the end of the current billing period. We do not provide refunds for part-used periods unless we are required to by law.

Official document fees (£7 per HM Land Registry title document) are charged separately from the subscription and are non-refundable once the document has been ordered. Ten posted letters are included each month; further letters are bought in advance as credits, from £1.30 per letter, and are non-refundable once the letter has been dispatched. You have certain rights over the way we process personal data relating to you. We aim to comply without undue delay, and within one month at the latest, in response to any request you make to us:

• for a copy of the personal data we hold about you, and to have inaccuracies corrected;
• to restrict or stop processing, or to delete your personal data;
• for a machine-readable copy of your personal data, which you can use with another service provider, and, where technically feasible, to have us send it directly to that provider;
• to object to processing carried out on the basis of our legitimate interests, including direct marketing; and
• to make a complaint to a data protection regulator. You can contact the Information Commissioner’s Office at https://ico.org.uk/concerns/.

To make a request in relation to any of these rights, email info@landicia.com. Please note that some information may remain in our private records after deletion, and we may continue to use aggregated data derived from your personal data in a form that does not identify you.

We share your personal data with third parties only in the ways described in this Policy.

• Suppliers and service providers. We keep your personal data confidential, but may disclose it to our personnel, suppliers or subcontractors (including hosting, payment, mapping, print and dispatch, analytics and support providers) insofar as it is reasonably necessary for the purposes set out in this Policy.
• Government authorities. We may disclose your personal data to the extent we are required to do so by law, in connection with legal proceedings or prospective legal proceedings, and to establish, exercise or defend our legal rights.
• Potential acquirers or investors. If we are involved in a merger, acquisition, or sale of all or part of our business or assets, the personal data we hold may form part of that transaction, in which case you will be notified by email, in your account, or by a prominent notice on the website.
• Enforcement. We may disclose personal data to third parties in order to enforce or apply the terms of agreements, to investigate potential breaches, or to protect the rights, property or safety of us, our personnel, our customers or others.

We only permit our suppliers and subcontractors to process your personal data for specified purposes and in accordance with our instructions. All of our third party service providers are required to take appropriate security measures to protect your personal data.

We only hold data about you for as long as necessary, bearing in mind the purpose for which it was collected, or as otherwise described in this Policy. Account and content data is retained for the life of your account and for a reasonable period afterwards to allow for reactivation, then deleted or anonymised. Billing records are kept for as long as we are required to keep them for tax and accounting purposes.

To determine the appropriate retention period we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure, the purposes for which we process it, whether we can achieve those purposes by other means, and the applicable legal requirements.

We take commercially reasonable, appropriate technical and organisational measures to ensure a level of security appropriate to the risk, taking into account the likelihood and severity of the risks that the use of the Service might pose to the rights and freedoms of our users and customers.

In particular, we take precautions to protect against the accidental or unlawful destruction, loss or alteration of, and unauthorised disclosure of or access to, the personal data we transmit, store or otherwise process. Access to customer data by our personnel is limited to those who need it to run the Service or to provide support.

Some of our service providers are based outside the United Kingdom. Where personal data is transferred outside the UK, we put agreements in place to ensure it is processed using appropriate safeguards that meet the requirements of data protection law. Those safeguards may include the UK International Data Transfer Agreement or Addendum, standard contractual clauses approved by the European Commission, or other appropriate measures.

The Service is intended for business use and we do not knowingly solicit data from, or market to, children. If a parent or guardian becomes aware that a child has provided us with information without their consent, they should contact us at info@landicia.com and we will delete that information within a reasonable time.

If you follow a link from the Service to any third party website, you should be aware that those websites have their own privacy policies. We do not accept any responsibility or liability for them. Please check the policies of any third party website before submitting personal data to it.

We may make changes to this Policy in the future, which will be posted on this page. You should check this page from time to time to make sure you are aware of any changes. Where appropriate we will notify you of changes by email.

Cookies are small text files placed on your computer or device by the websites you visit and the applications you use. They are widely used to make websites and applications work, or work more efficiently, and to provide information to the owners of those sites and apps. The cookies and similar technologies we use fall into the following categories.

• Strictly necessary. Used to sign you in, keep you signed in, remember your session, and protect the Service against abuse. These cannot be turned off without breaking the Service, and are not used for marketing.
• Analytics. Used to collect information about how visitors and customers use the Service so we can compile reports and improve it. These are set only where you have consented, where consent is required.
• Preferences. Used to remember choices you make, such as map settings and saved views, so you do not have to set them again.

Some cookies may be set by third parties when you use the Service, for example our analytics, payment and mapping providers. These cookies are controlled by those third parties, so please check their websites for more information about them and how to manage them. If you share our content through a social network, that network may also set cookies; we cannot control those, and suggest you check the relevant network’s own information.

You can control cookies through your browser settings, including deleting cookies already set and blocking future ones. Blocking strictly necessary cookies will stop parts of the Service from working. Where we ask for your consent to non-essential cookies, you can change your choice at any time by clearing the cookies for this site in your browser and making a new selection, or by emailing info@landicia.com.

The Service contains public sector information licensed under the Open Government Licence v3.0. Property and planning data is drawn from public registers and official services, including HM Land Registry, and is attributed to its source where shown.
